Terms & Conditions

1. ACCEPTANCE

1. PennyWebsiteJobs ("pennywebsitejobs.com"), is a provider of web design, website maintenance, digital photos retouching/manipulations, website updates, website edit and other related services (collectively, the "Jobs"). In these terms and conditions, "we", "us", "seller" or "our" means PennyWebsiteJobs.
2. By ordering any of the Jobs, you agree, without limitation or qualification, to be bound by these terms and conditions and such other additional or alternative terms, conditions, rules and policies which are displayed or to which you may be directed in connection with any particular Jobs, as all of the same may be modified by PennyWebsiteJobs from time to time (collectively the "Terms and Conditions"). Please note that the Terms and Conditions may be updated from time to time without notice to you, so please check back periodically.

2. THE HIGHLIGHTS

1. Only registered users can buy Jobs on PennyWebsiteJobs. Registration is free.
2. Buyers are granted all rights for the delivered work, unless otherwise specified by the seller in the job description.
3. Buyers pay PennyWebsiteJobs for Jobs in advance.
4. Both buyer and seller have the option to cancel an order by mutual agreement.
5. PennyWebsiteJobs will not accept jobs that imply working with copyright protected, violent, hatred content.
6. PennyWebsiteJobs reserves the rights to refuse providing jobs at its sole discretion for any other reason which PennyWebsiteJobs chooses.


3.WORK DELIVERY AND COMMUNICATIONS

1. You are responsible to scan all transferred files for viruses and malware. PennyWebsiteJobs will also scan all files we transfer back and/or upload to the customer's server for viruses and malware.
2. Once job is delivered, the buyer has three days to respond. After that time, the order will be marked as complete.


4. ORDERING JOBS

1. Jobs may be purchased using a Credit Card, Wire Transfer (for orders over $100.00) or AlertPay
2. Once payment is confirmed, your order will be created.
3. PennyWebsiteJobs will verify the order details and contact you for additional details in case these are required (ftp access passwords for maintenance and update/edit jobs, etc.).
4. PennyWebsiteJobs will inform you about the turnover time of your job and once a written agreement from you is received to procede we will execute the job.


5. OWNERSHIP AND LIMITATIONS

1. Unless clearly stated otherwise in the Job description text, when the job is delivered, the buyer is granted all intellectual property rights, including but not limited to, copyrights for the job delivered from PennyWebsiteJobs and PennyWebsiteJobs waives any and all moral rights therein. For removal of doubt, in custom created work (such as art work, design work, report generation etc.), the delivered job shall be the exclusive property of buyer. The seller expressly agrees to assign to buyer the copyright in any delivered services that do not meet the requirements of a work-for-hire under the U.S. Copyright Act. Additionally, independent of the U.S. Copyright Act, the seller agrees that unless he indicated otherwise in the Job description, once the order is completed the seller assigns along with it to the buyer, to the fullest extent possible under the law, all of its right, title and interest, if any, in and to the delivered service and waives any and all moral rights in connection therewith.
2. PennyWebsiteJobs further assert that whatever information received from the buyer, which is not public domain, shall not be used for any purpose whatsoever other than for the delivery of the work to the buyer.


6. INDEMNIFICATION

1. You agree that our entire liability, and your exclusive remedy, with respect to any Jobs and any breach of the Terms and Conditions is solely limited to the amount you paid for such Jobs. We and our agents and contractors shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use any of the Jobs or for the cost of procurement of substitute Jobs. We disclaim any and all loss or liability resulting from, but not limited to:

1.1 loss or liability resulting from access delays or access interruptions
1.2 loss or liability resulting from data non-delivery or data mis-delivery
1.3 loss or liability resulting from acts of God
1.4 loss or liability resulting from the unauthorized use or misuse of your account identifier or Password
1.5 loss or liability resulting from errors, omissions, or misstatements in any and all information or jobs provided

In no event shall our maximum liability exceed five hundred ($100.00) dollars.

2. You agree to release, indemnify, and hold us, our contractors, agents, employees, officers, directors and affiliates harmless from all liabilities, claims and expenses, including lawyers fees, relating to or arising under the Terms and Conditions, the Jobs or your use of the Jobs, including without limitation infringement by you, or someone else using the Jobs with your computer, of any intellectual property or other proprietary right of any person or entity, or from the violation of any of our operating rules or policy relating to the Jobs.


7. REVISSIONS TO THE TERMS OF SERVICE

PennyWebsiteJobs reserves the right to revise, amend, or modify this TOS and its other policies and agreements at any time and in any manner and any such modification shall be automatically effective as to all customers when adopted by PennyWebsiteJobs and published here.
